論理的思考(Type of Reasoning)をめぐる英語表現 (1)

【はじめに】 二つの思考の型-帰納法と演繹法(特に三段論法)
There are two types of reasoning: induction and deduction (or inductive reasoning and deductive reasoning). Virtually any piece of reasoned discourse including more than one or two logical steps will ordinarily include both types. The two are interdependent, and the two are basically different.

【訳】考えをまとめる思考方法には2種類ある。帰納法と演繹法である。大体において人を納得させる一つまたは二つ以上の過程(logic steps)を踏んだ論述過程(reasoned discourse)にはこの二つがからんでくるものである。二つはお互い依存し合っている(interdependent)が、元来は別のものである。

【特許請求の範囲は帰納法か演繹法か】
明細書の「発明の詳細な説明」には複数の実施例(実施態様)が書かれ、それらに共通する事項が集められ(抽象)、非共通事項が捨てられて(捨象)特許請求の範囲(クレーム)としてまとめられる。典型的な帰納法である。他方、法律の運用(解釈・適用)は演繹法で、特に三段論法がとられる。

(1) 帰納法 (Induction)
Induction is that kind of reasoning which proceeds from the particular to the general. That is, in deduction we begin with a number of particular facts and formulates a general statement or principle which covers them or indicates what they all have in common. During the early years of our life, for example, when we are beginning to develop our knowledge, presumably there are a number of occasions when we are near a fire. In each of these individuals, separate, particular experiences we have a sensation of heat. Before long, though we probably do not state our conclusion explicitly, we have come to understand the general principle that fire is hot. In this way we have actually reasoned by induction.

【訳】 帰納法とは、特殊事例(the particular)から一般論(the general)を導く方法である。すなわち、帰納法では数多くの特定の事実(particular facts)から始めて、それら事実を包含する(cover)、またはそれら事実に共通することを示す一般論または原則を定立する。ものを覚えはじめた幼かりしころに、火に近いところにいる機会が多かったとする。個別的で、それぞれ独自の体験の中で我々は熱とはどういうものなのかを感覚的に知るようになる。やがて明確には結論を述べるわけではないが、火とは熱いものだという知識を得るようになる。このようにして我々は帰納法によって推論したことになる。

(2) 演繹法 (Deduction)
Deduction is that kind of reasoning which proceeds from the general to the particular. That is, in deduction we begin with a general statement or principle ad apply it to a particular case. We know it to be a valid general principle, for example, that water freezes at any temperature below 00 C. On a particular occasion we find the temperature outdoors down to -50 C. Applying the general principle, we will deduce that unless we add antifreeze to the water in our automobile radiator, the water will freeze. Then, an action starts. 

【訳】 演繹法とは、一般論(the general)から特殊事例(the particular)に進む方法である。すなわち、演繹法では一般論または原則から始めて、それを特定の事例(particular case)に適用する。たとえば、我々は、水は摂氏0°以下になれば凍結するという一般原理を知っている。ある時、外の温度が摂氏-6°になっていることを知ると、先ほどの一般的原理と適用して、不凍液を車のラディエーター入れておかなかったら水は凍結すると演繹的に結論する。直ちに行動に移る。

(3) 三段論法(Syllogism)
Syllogism is a traditional device for showing clearly the relationship among the ideas included. The syllogism consists of three parts: (1) the major premise, stating the general principle on which the reasoning is based; (2) the minor premise, indicating the particular case to which the general principle is applied; and (3) the conclusion, which completes the logic of the application.
             
【訳】三段論法とはそこに含まれている幾つかの考え(ideas)の間の関係を明確に示す伝統的な手段(traditional device)である。三段論法は三つの部分からなっている。第1は大前提(major premise)で、ここで考えの基となる一般的原則を述べる。第2は小前提(minor premise)で、ここではその一般原則が適用される特殊な事例を示す。第3は結論で、ここで先ほどの一般的原則の適用の論理性を完結する。次項その(2)では、判例法にみる三段論法を検証することにする。
